Crucial Operational & Liability Notice

Patrofi (“Patrofi”, “we”, “us”) provides software-as-a-service (SaaS) workflow and telemetry infrastructure only. Patrofi is NOT a security guard provider, an insurance underwriter, or a public emergency dispatch agency. Use of the Patrofi software does NOT guarantee prevention of crime, theft, property loss, or personal injury. Please read Section 2 and Section 9 carefully regarding limitation of liability and operational disclaimers.

1. Acceptance of Terms & Legal Authority

1.1 Binding Agreement: These Terms of Service (“Agreement”) constitute a legally binding contract between Patrofi(“Company”, “Patrofi”, “we”, “us”, or “our”) and the legal entity or individual registered as the customer (“Customer”, “Organization”, or “you”).

1.2 Authority: If you are creating an organization workspace on behalf of a private security agency, corporate enterprise, facility management company, or residential estate authority, you represent and warrant that you possess full corporate and legal authority to bind that entity to this Agreement.

1.3 Authorized Users:Customer is responsible for ensuring that all administrators, dispatchers, field supervisors, and rostered security personnel (“Authorized Users”) comply fully with this Agreement.

2. Nature of Service & Security Disclaimers

2.1 Software Platform Exclusivity: Patrofi provides a cloud-based software platform for electronic guard tour scheduling, presence verification, GPS geofencing, digital incident reporting, and Security Operations Center (SOC) telemetry.

2.2 No Physical Security / Not an Insurer: Patrofi is nota licensed physical security guard company, does not employ or deploy physical guards, and does not provide physical protection, policing, surveillance operations, or municipal armed response. Patrofi is not an insurer of Customer's premises, inventory, personnel, or assets.

2.3 No Guarantee of Threat Prevention: Patrofi does not guarantee that the use of our software will prevent burglary, theft, unauthorized access, vandalism, workplace violence, fires, property damage, or bodily injury. Customer maintains 100% operational responsibility for physical security deployments and guard performance.

3. Lone Worker SOS Panic Alarms & Safety Telemetry

3.1 Best-Effort Operational Signaling:The Lone Worker SOS panic button, inactivity alerts, and siren notifications provided in the guard terminal application are internal operational communication tools designed to notify the Customer's SOC dashboard and designated contacts.

3.2 No Direct Public Emergency Link: The SOS feature does not automatically connect to public emergency dispatchers (e.g., Police, Fire, Ambulance, or government emergency services 112/911). Customer is responsible for triaging internal alerts and contacting municipal emergency responders.

3.3 Network & Device Dependencies: SOS alerts rely on cellular mobile data, Wi-Fi networks, push notifications, and device power state. Patrofi disclaims any and all liability for delayed, dropped, or undelivered SOS transmissions resulting from telecommunication carrier outages, dead battery states, hardware damage, or lack of network reception.

4. Checkpoint Tokens, Touch Verification & Offline Sync

4.1 Physical Checkpoint Tokens & NFC Tags: Checkpoint verification utilizes physical NFC touch verification tokens affixed to physical facilities. Customer is solely responsible for purchasing, physical installation, maintenance, and physical security of tags at designated sites.

4.2 Anti-Cloning & Tamper Policy: Attempting to reverse-engineer, duplicate, simulate, or tamper with Patrofi checkpoint security tokens constitutes a severe material breach resulting in immediate workspace termination without refund.

4.3 Offline Caching & Synchronization:When officers patrol underground corridors or areas without network connectivity, scan records and compressed incident photos are buffered in the device's local secure cache. The Customer acknowledges that live SOC dashboards will not reflect offline events until the device re-establishes internet connectivity and completes background synchronization.

5. Guard Employee Consent, GPS & Labor Compliance

5.1 Customer Warranty of Consent: Customer warrants and covenants that it has established lawful bases and obtained all requisite written consents and labor notices from employed security guards for GPS coordinate tracking, device telemetry, shift timestamps, and incident photo capture in accordance with the Nigeria Data Protection Act, 2023 (NDPA), the Nigeria Data Protection Regulation (NDPR), and applicable employment laws.

5.2 Shift-Only Tracking Safeguard: The Patrofi terminal collects location telemetry strictly while an officer has an active patrol shift in progress. The mobile application terminates location sampling upon shift completion or clock-out.
